Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and HighDanger ("HighDanger," "we," "us," or "our") governing your use of highdanger.com and our related services (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

HighDanger is an independent hockey analytics product. We are not affiliated with, endorsed by, or sponsored by the National Hockey League (NHL), any NHL team, or any other league. NHL and team names and marks belong to their respective owners and are used here for identification and commentary only.

2. Your account

• You must be at least 13 years old to create an account.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• You agree to provide accurate information and to keep it current.
• Notify us promptly at hockeyops@highdanger.com of any unauthorized use of your account.

3. Acceptable use

You agree not to:

• Access the Service, including the AI assistant or any API, through bots, scripts, scrapers, or other automated means, except as we expressly permit.
• Circumvent, disable, or interfere with usage limits, rate limits, authentication, or security features.
• Resell, redistribute, sublicense, or commercially exploit the Service, our data outputs, or our models without our written permission.
• Reverse engineer, scrape, or attempt to extract or reconstruct our proprietary models or metrics.
• Create multiple or fake accounts to obtain additional free usage.
• Upload or submit unlawful, abusive, infringing, or harmful content.
• Use the Service in any way that violates applicable law or these Terms.

4. The AI assistant

The AI assistant answers hockey questions using our data and models. It is provided for information and entertainment only. It can be incomplete or wrong, and it is not professional, financial, medical, or legal advice. The Service does not provide betting, wagering, or gambling advice, and you must not rely on it for those purposes. Free accounts include a limited number of questions per month; limits and tiers may change.

5. Subscriptions and payments

• Some features may require a paid subscription. Prices, features, and limits are described at the point of purchase and may change with notice.
• Paid plans are billed through Stripe. By subscribing, you authorize recurring charges until you cancel.
• You can cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable.

6. Intellectual property

The Service, including our software, design, written content, and our proprietary models and derived metrics (such as our Expected Goals and Goals Saved models and related outputs), is owned by HighDanger and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. Underlying factual hockey statistics are not owned by us and are drawn from public sources.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Statistics, projections, ratings, and comparables are estimates and predictions, not guarantees, and may be inaccurate. You use the Service at your own risk.

8. Limitation of liability

To the fullest extent permitted by law, HighDanger and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or fifty U.S. dollars.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or create risk or legal exposure for us. Sections that by their nature should survive termination will survive.

10. Changes to the Service and these Terms

We may modify or discontinue features at any time. We may also update these Terms; we will revise the "Last updated" date and, for material changes, provide more prominent notice. Your continued use after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute, except where applicable law provides otherwise.
